Not comparable but near enough?

North dealer

South opens 1S out of turn, not accepted

Bidding reverts to North who opens 1H

If South bids 1S now; is it comparable?

Strictly speaking it is not (with the extra knowledge the 6-11 point range is excluded)
But it is my view it should be treated as “near enough” to be comparable and the bidding allowed to continue.

It is hard to see how the opponents might be damaged.
North will always make the same rebid he would make with a 6+ response rather than 12+

and then South shows his extra strength in the same way and the outcome would be normal.

If North was required to pass South would need to guess with one bid and that could lead to a ridiculous contract.
The laws are intended to achieve a normal bridge result as much as possible

Other views please?

Also what if the original bid out of turn was a minor so the only difference in the (2-level) response is 10+ instead of 12+
